Mass Tort
A “tort” occurs when a person harms another through their negligent, reckless or intentional act. A “mass tort” arises when the same wrongful act harms numerous people in the same way. Mass torts commonly involve people harmed by defective products such as medical devices or pharmaceutical products. A mass tort often is triggered by a U.S. Food and Drug Administration warning, product recall, news reports or a study that reveals dangers associated with a product. “MDL” stands for “multidistrict litigation” and “MCL” means “multicounty litigation”. When many different plaintiffs file lawsuits in federal or state courts in different parts of the country against the same defendants, alleging similar harm, the lawsuits can be centralized in the same U.S. District Court or the same State Court where the manufacturer is based. MDLs and MCLs are common in product liability claims. An MDL or MCL helps to speed up timelines, cut down on the costs of litigation, and avoid the risk of inconsistent rulings. At the same time, it allows individual plaintiffs to maintain separate lawsuits. An MDL has been formed in the Northern District of Illinois. Tepezza is a drug intended to treat the symptoms of thyroid eye disease or Graves’ disease. Soon after Tepezza was released on the market, it was discovered that Tepezza can cause hearing damage and/or ringing in the ears in patients.

Camp Lejeune claims hold the government accountable for supplying drinking water contaminated with toxic chemicals to individuals who visited the base camp. Talcum powder has been linked to cases of ovarian cancer in women that use, or used, the product often. Many women who routinely used contaminated talcum powder may only just now develop symptoms of mesothelioma or ovarian cancer. An MDL has been formed in the District of New Jersey.

The plastic polypropylene used in these devices has been established as defective since it degrades, breaks, deforms, shrinks or contracts, is stiff, and exhibits numerous other problems. Ozempic is a popular drug for type-2 diabetes management and it is also popular for use as a weight loss drug. Wegovy is the drug that is specifically marketed for weight loss. New evidence from the FDA has recently shown that taking Ozempic or Wegovy can significantly increase the risk of gallbladder disease, often resulting in gallbladder removal or other health consequences. An MDL has been formed in the Eastern District of Pennsylvania.
