Medical Malpractice

Medical malpractice is a legal cause of action that occurs when a healthcare or medical professional deviates from a professional standard of care (by a negligent act or omission), which results in injury to a patient. If you or a family member was hurt or injured while under the care of a medical professional, it may establish medical negligence. Medical negligence is a violation of a standard of care for medical treatment. Standard of care refers to a generally accepted set of practices that other healthcare providers provide to other patients in a similar situation. Failure to meet this standard may be considered medical malpractice.  Every year, thousands of patients are injured because of medical malpractice and negligence. Every doctor takes an oath where he or she promises to never cause a patient any harm.  Patients inherently trust their doctors, nurses, and other medical professionals, and follow their treatment recommendations.  Medical malpractice is one of the most common causes of death in the country behind cancer and heart disease.  Types of medical malpractice actions may involve misdiagnosis of conditions or diseases, misreading of lab results, mistakes made during surgery or other procedures, patient neglect, and several others.
